From 1 January 2010, the new Safety Net – comprised of modern Awards and the new National Employment Standards - introduced by the Fair Work Act 2009 will be in operation.

The introduction of the Safety Net is the second, and final, transitional stage of the introduction of the Fair Work Act 2009.

Modern Awards will be underpinned by the National Employment Standards. The National Employment Standards are ten legislated minimum standards which will replace the Australian Fair Pay and Conditions Standard from 1 January 2010.

In most cases, employers will have to contend with transitioning to a broad range of new employee entitlements, and limited scope for arrangements that vary, modify or exclude modern Award conditions.

Please note: The Modern Awards and NES will also impact on businesses that already have common law contracts, individual statutory agreements, and collective agreements, in place.

Modern Awards

Below is a list of all stages of Modern Awards that have been currently released by the Australian Industrial Relations Commission as of 8 February 2010.

Please be aware that Transitional Provisions may apply to many of these awards, but may not have been inserted by the Commission as yet.

Additionally, the Commission has not finalised all amendments to these documents. Awards for a few industry sectors have yet to be released.

VECCI advises that you are mindful of the progressive changes to all documentation in relation to the Modern Awards process, whilst we will try to ensure that the most up to date versions are available from this website.

Since the timelines for the finalisation for the Modern Awards have yet to be announced by the Commission, it has made the provision of current versions of documents very difficult on this website.
