VECCI Award Services
VECCI’s Award services and publications are compiled by our expert team of workplace relations specialists and are regularly updated to reflect complex legislative changes to industrial relations – workplace relations laws.
NAPSAs and Federal Awards (effective until 31 January 2009)
VECCI produces a wide range of Federal Award and NAPSA publications, available on a subscription basis. Subscriptions include:
- A copy of the Award, broken down into easy-to-read sections.
- A copy of the Pay Scale.
- A guide to the Australian Fair Pay and Conditions Standards.
The initial subscription will provide either a hard or electronic copy of the Award service. VECCI will then distribute updates – for example, when the Australian Fair Pay Commission adjusts the pay scale derived from the Award or NAPSA – to ensure subscribers’ continuing compliance with employer obligations under the Award.
Subscription ensures employers stay up to date with key workplace relations changes, as they happen, providing the ultimate in business assurance.
Modern Awards (effective 1 January 2010)
What is a Modern Award?
One of the key aspects of the introduction of the Fair Work Act 2009 is the new ‘Safety Net’, comprised of Modern Awards and the National Employment Standards (NES). The Safety Net commences on 1 January 2010.
The Australian Industrial Relations Commission (AIRC) has been given the task of modernising Awards. Modern Awards are industry-based and will apply to all employees in the national (or federal) industrial relations – workplace relations system.
Modern Awards build on the NES and may include an additional ten minimum conditions of employment tailored to the needs of the particular industry or occupation. These include minimum wages, types of employment, arrangements for when work is performed, overtime and penalty rates, annualised wage or salary arrangements, allowances, leave-related matters, superannuation and procedures for consultation, representation and dispute settlement.
The AIRC will include a flexibility clause in each Modern Award, which will enable employers and employees to negotiate arrangements to meet their individual needs. Protections will ensure that an employee is better off overall under the flexibility arrangement.
Stages One and Two of Modern Awards have been determined by the full bench of the AIRC. Stages Three and Four will be determined in the coming months.
How will VECCI assist businesses with the transition to the new Safety Net?
VECCI will be publishing the new, industry-based Modern Awards that comprise the new Safety Net introduced by the Fair Work Act 2009, effective on 1 January 2010.
VECCI’s Modern Award toolkits will include:
- A guide to the National Employment Standards.
- The National Employment Standards, excerpted from the Fair Work Act 2009.
- The Modern Award.
- Information on issues relevant to the interpretation of Modern Awards. For example, Modern Awards re-introduce entitlements disallowed by the WorkChoices reforms to pre-reform Awards (i.e. those Awards in place between 27 March 2006 and 31 December 2009).
