Some employers could be caught out by the new safety net which came into effect on 1 January 2010, where existing awards and statutory minima will progressively be replaced by 122 modern awards and ten national employment standards.

The regulatory and compliance obligations that accompanied the commencement of the new safety net are considerable, and modern awards are likely to increase the costs burden to business.

The transition to the new safety net is a significant issue for business. For the new safety net to be meaningful - and indeed, for modern awards to meet the modern awards objective as prescribed by the Fair Work Act 2009 - such a safety net must be easily implemented.

Modern Awards and the National Employment Standards

Don’t get caught: the new Safety Net

From 1 January 2010, the new Safety Net introduced by the Fair Work Act 2009 will be in operation.  The new Safety Net is comprised of two elements – modern Awards; and the National Employment Standards (NES).  The Modern Awards and NES will also impact on businesses that already have common law contracts, individual statutory agreements, and collective agreements, in place.

These sessions will cover a range of matters related to the modern Award, including:

  • How the modern Award varies from its pre-reform equivalent;
  • Interpreting the Award;
  • The making of individual flexibility agreements;
  • The interaction of the modern Award with the National Employment Standards; and
  • An explanation of the complex transitional arrangements that may apply to your business.
